Careless Driving
The Court: Broadmeadows Magistrates’ Court
The Date: October 2025
The Charges:
- Section 65 of the Road Safety Act – careless driving
A fine of up to $2442.00 and a licence loss at the Magistrates’ discretion
Our client was a truck driver who was towing a trailer which was loaded with 24,028 kilograms of paper rolls. Our client was performing a right-hand turn and performed the turn at a speed that was too fast for the vehicle and trailer to safely negotiate.
The vehicle and trailer tipped onto it’s left side, destroying a traffic control signal before coming to a rest on it’s side past the intersection.
We advised our client to plead guilty to the single charge and the court imposed a same day diversion for our client. Our client was very pleased as they kept their licence and did not incur a fine for the incident.
