The Charges:
  1. Road Safety Act, Section 64(1) – driving a motor vehicle dangerously
  2. Road Safety Act, Section 65 – driving a motor vehicle carelessly
  3. Road Safety Road Rules 132(2) – overtaking over single continuous dividing line
  4. Road Safety Road Rules 142(1) – passing to the right of right turning vehicle
Possible penalties our client was facing:
Charge 1:

A fine of $48,842.40 or imprisonment for up to 2 years or both, and further licence disqualification of 6 months

Charge 2:

A fine of $2442.12 and a loss of licence for a period at the discretion of the Magistrate

Charge 3:

A fine of $2035.10

Charge 4:

A fine of $2035.10

The Facts of the Case:

Our client was driving in a 100km/h zone behind two other cars. Our client intended to overtake the car directly in front which was turning left. Our client attempted to overtake this car and collided with the driver’s side of the car two in front, causing injuries to passengers of the other vehicle.

Our client was aware of both vehicles, but thought both vehicles were turning left as she had not seen a right indicator, and was unaware she was attempting to overtake on a continuous dividing line.

Negotiations with police before court:

We negotiated with police prior to court and were able to get Charges 1 and 3 withdrawn.

The Result:

In court, the Magistrate imposed a fine of $1400 without conviction and there was no further licence loss for our client.
