The Facts of the case:

Our client was a high school student who had been working late assisting with the production of an upcoming school musical. As a result of the excessive workload, combined with his school commitments, he accidentally fell asleep at the wheel while driving on Edgerton Road, Mitcham.

As a consequence, he lost control of the vehicle, which mounted the median strip and collided with a light pole, causing it to collapse across all three eastbound lanes. The vehicle then crossed three lanes of oncoming traffic before coming to a stop.

Police attended the scene. Fortunately, no injuries were sustained as a result of the collision.

Outcome of the case

Our client was granted a same-day diversion after entering a plea of guilty. As a result, he retained his licence and avoided any penalties, including a fine.

He was required to be of good behaviour, provide a letter of gratitude to the informant, and make a donation to the Amber Community. Our client and his family were very pleased with the outcome, as it allowed him to retain his licence for work, school, and travel to assist his family on a farm.
